Terms of Service

Welcome to bjora, a service operated by Aspire Content Strategy, LLC, doing business as bjora (“bjora,” “Company,” “we,” “our” or “us”).

These Terms of Service govern your access to bjora.com and your purchase or use of bjora’s design, hosting and management services. By accessing the website, purchasing a service or authorizing work to begin, you agree to these Terms.

1. Services

bjora designs, develops, hosts and manages custom microsites and related promotional materials for economic development, investment attraction and similar marketing purposes.

The specific services and deliverables included in a project are determined by the package purchased, the applicable order confirmation and any additional written agreement between bjora and the client (“Client” or “you”).

bjora is not a real estate brokerage, site-selection consultancy, financial adviser or legal adviser and does not participate in real estate or investment transactions.

2. Project Scope

A bjora package may include:

  • One or more custom microsites
  • Desktop, tablet and mobile optimization
  • Hosting and technical management
  • Website analytics
  • Promotional graphics and digital assets
  • Periodic design and performance reviews
  • Other deliverables described at the time of purchase

Only services expressly included in the selected package or a written project agreement are included. Additional content, design, revisions, functionality or services may require a separate fee.

If these Terms conflict with a signed agreement or written order confirmation, the signed agreement or order confirmation will control.

3. Client Materials and Responsibilities

You may provide bjora with logos, photographs, videos, documents, data, testimonials, trademarks and other materials for use in your project (“Client Materials”).

You represent and warrant that:

  • You own the Client Materials or have permission to use them
  • The information you provide is accurate to the best of your knowledge
  • The Client Materials do not violate any law or third-party rights
  • Any individuals quoted, photographed or identified have provided any required permissions
  • You are authorized to act on behalf of the organization purchasing the services

You remain responsible for reviewing and approving factual claims, statistics, contact information and other content before publication.

4. License to Use Client Materials

You retain ownership of your Client Materials.

You grant bjora a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, format, display and distribute the Client Materials as reasonably necessary to design, operate, host, maintain and promote your project.

This license continues for as long as necessary to provide the services and maintain reasonable business, legal or backup records.

5. Design, Review and Approval

bjora will create the project based on the selected package, information supplied by the Client and bjora’s professional design judgment.

Project schedules are estimates and may be affected by the Client’s response time, availability of materials, requested changes and technical circumstances.

The Client is responsible for reviewing proofs, concepts and completed work. Approval authorizes bjora to finalize or publish the project. Changes requested after approval may be treated as additional work and priced separately.

6. Hosting and Availability

Unless otherwise agreed in writing, bjora microsites are hosted and managed by bjora on a bjora-controlled domain, subdomain or hosting environment.

bjora will use commercially reasonable efforts to maintain reliable service but does not guarantee uninterrupted or error-free availability. Temporary interruptions may occur because of maintenance, security issues, hosting failures, internet outages or circumstances beyond our reasonable control.

bjora may perform updates, maintenance or security work when reasonably necessary.

7. Fees and Payment

Fees may include a one-time onboarding fee and a recurring monthly hosting and management fee.

All charges are presented before purchase. Payments are processed through third-party payment providers, including Stripe. You authorize bjora and its payment provider to charge the payment method supplied for all applicable fees and taxes.

You are responsible for maintaining valid and current payment information.

Except where required by law or expressly stated otherwise, onboarding fees become nonrefundable once project work begins.

8. Recurring Billing

Monthly hosting and management fees are billed in advance and automatically recur until canceled.

By purchasing a recurring service, you expressly authorize bjora to charge the disclosed monthly fee to your selected payment method each billing period.

bjora may change future pricing or service features with reasonable advance notice. A pricing change will not apply retroactively to charges already paid.

9. Cancellation

There is no long-term commitment unless a separate signed agreement states otherwise.

You may cancel recurring services at any time by emailing info@bjora.com or submitting a request through the bjora Contact page.

Cancellation prevents charges for future billing periods but does not automatically generate a refund for onboarding fees, completed work or the current billing period.

Unless otherwise agreed, hosting and management will continue through the end of the paid billing period. The microsite may be unpublished or removed after that period ends.

10. Delivered Materials

Upon full payment, you may use final promotional graphics, presentations, QR codes and other completed files delivered to you for your organization’s marketing purposes.

bjora retains ownership of its underlying templates, methods, systems, code, processes, tools and reusable design elements. No ownership of those underlying materials is transferred to the Client.

Third-party photographs, fonts, software or other licensed materials remain subject to their respective license terms.

11. Analytics

Any analytics or performance information provided by bjora is based on data supplied by third-party services and available tracking technologies.

Analytics may be affected by browser settings, consent choices, ad blockers, privacy tools, technical interruptions and other factors. bjora does not guarantee that analytics will capture every visit, interaction or inquiry.

12. No Guarantee of Results

bjora does not guarantee:

  • Website traffic
  • Leads or inquiries
  • Meetings
  • Sales or leases
  • Investment decisions
  • Business recruitment
  • Search-engine rankings
  • Economic development outcomes
  • Any particular conversion or response rate

Results depend on numerous factors outside bjora’s control, including the Client’s offer, audience, promotional activity, market conditions, content, reputation and competitive environment.

Any performance statistics, examples or projections are illustrative and are not promises of future results.

13. Confidential and Public Information

Microsites are created for public marketing purposes. Information submitted for inclusion in a microsite may become publicly accessible after publication.

Do not submit confidential, proprietary, export-controlled or sensitive personal information unless bjora has expressly agreed in writing to receive and protect that information.

14. Prohibited Content and Use

You may not submit or use bjora’s services to publish:

  • False, fraudulent or materially misleading information
  • Content that infringes copyrights, trademarks or other rights
  • Illegal, defamatory, threatening or discriminatory content
  • Malicious software or harmful code
  • Content that violates privacy or publicity rights
  • Material intended to disrupt bjora’s services or systems

bjora may reject, remove or decline to publish content that it reasonably believes violates these Terms or creates legal, security or reputational risk.

15. Suspension and Termination

bjora may suspend or terminate services if you:

  • Fail to pay applicable fees
  • Violate these Terms
  • Provide fraudulent or unlawful content
  • Misuse the services
  • Create a legal or security risk
  • Interfere with bjora’s systems or operations

When reasonably practical, bjora will provide notice and an opportunity to address the issue before terminating service.

16. Intellectual Property

The bjora name, branding, website, design systems, software, templates, processes and proprietary materials are owned by Aspire Content Strategy, LLC or its licensors.

Except for the limited rights expressly granted in these Terms, you may not copy, reproduce, resell, distribute or create derivative works from bjora’s proprietary materials without written permission.

17. Third-Party Services

bjora may use third-party services for payment processing, hosting, analytics, email delivery, forms, security and other business functions.

These providers operate under their own terms and privacy policies. bjora is not responsible for an interruption or failure caused solely by a third-party service outside its reasonable control.

18. Disclaimer of Warranties

To the maximum extent permitted by law, bjora’s website and services are provided on an “as-is” and “as-available” basis.

bjora disclaims warranties not expressly stated in writing, including implied warranties of merchantability, fitness for a particular purpose and noninfringement.

19. Limitation of Liability

To the maximum extent permitted by law, bjora and Aspire Content Strategy, LLC will not be liable for indirect, incidental, special, exemplary or consequential damages, including lost profits, lost opportunities, lost data, reputational harm or service interruptions.

bjora’s total liability arising from a claim will not exceed the amount paid by the Client to bjora during the 12 months immediately preceding the event giving rise to the claim.

Some jurisdictions do not permit certain limitations of liability, so portions of this section may not apply.

20. Indemnification

You agree to defend, indemnify and hold harmless bjora, Aspire Content Strategy, LLC and their owners, officers, employees, contractors and affiliates from claims, damages, liabilities and reasonable expenses arising from:

  • Client Materials
  • Your use of the services
  • Your violation of these Terms
  • Your violation of applicable law
  • Your infringement of third-party rights

21. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles.

Any legal proceeding arising from these Terms or the services must be brought in a state or federal court with appropriate jurisdiction in North Carolina.

22. Changes to These Terms

bjora may update these Terms periodically. Revised Terms will be posted on the website with an updated effective date.

Changes will apply prospectively unless otherwise required by law. Continued use of the website or services after revised Terms become effective constitutes acceptance of those revisions.

23. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. The unenforceable provision will be modified only to the extent necessary to make it enforceable.

24. Entire Agreement

These Terms, the applicable order confirmation, the Privacy Policy and any signed written agreement constitute the entire agreement concerning the services and replace prior discussions or communications about the same subject.
